For existing customers with completed purchases prior to the amendment date, the original Terms of Service in effect at the time of their purchase shall continue to govern that specific transaction.
Future Purchases: By making any purchase after the effective date of amended Terms of Service, customer agrees to be bound by the updated terms for that purchase and all subsequent purchases. Continued use of our website or services after amendments constitutes acceptance of the modified terms for future transactions.

GOVERNING LAW & JURISDICTION
Governing Law: These Terms of Service and all transactions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. By making any purchase or using this website, customer irrevocably consents to the exclusive jurisdiction of the state and federal courts located in Leon County, Florida for resolution of any disputes.
Interstate Commerce & Firearms: Notwithstanding the above, all firearm transactions are subject to applicable federal law and must comply with the laws of both Florida and the state where the firearm is delivered, as required by 18 U.S.C. § 922(b)(3) and other federal firearms statutes. Where federal law or the law of the destination state provides greater consumer protection or imposes additional requirements, such laws shall also apply.
Consumer Protection Laws: Nothing in this choice of law provision shall be construed to waive any mandatory consumer protection laws of the customer’s state of residence where such waiver would be contrary to public policy or prohibited by applicable law.
Agreement to Jurisdiction: By completing any purchase, customer agrees to submit to the personal jurisdiction of Florida courts for all disputes arising from or related to purchases, returns, refunds, abandoned property, and all other matters covered by these Terms of Service, to the maximum extent permitted by law.

AGREEMENT TO POLICY
PAYMENT CONSTITUTES AGREEMENT: By making any payment via any method (cash, check, credit card, debit card, electronic transfer, or any other payment method), customer understands and agrees to this entire policy even if they do not physically sign this agreement. Payment of any amount serves as customer’s legal acceptance of all terms and conditions contained herein.
By completing this purchase, customer acknowledges:
- All sales are final and non-refundable
- No cash refunds, store credit, or exchanges provided
- Merchandise accepted in current condition
- Customer has inspected items before purchase
LIMITED EXCEPTIONS
Refunds ONLY for merchant error:
- Wrong item shipped by merchant
- Inventory/processing error by merchant
- Merchant cannot deliver as promised
NOT COVERED: Change of mind, sizing issues, compatibility problems, buyer’s remorse, or customer damage.
SHIPPING & DELIVERY POLICY
Definitions:
- “Business days” exclude weekends (Saturday and Sunday) and federal holidays
- “Calendar days” include all days including weekends and holidays
- All timeframes calculated from order date unless otherwise specified
Standard Shipping Timeframe: Standard orders are processed and shipped within 30 business days from order date. Orders over $1,000 may require up to 45 business days for enhanced security verification. Typical processing time is 3-10 business days for verified orders under $250. Processing times vary based on product availability, customization requirements, order volume, and security verification requirements.
Force Majeure: Shipping timeframes may be extended due to circumstances beyond merchant’s reasonable control, including but not limited to: federal background check delays, ATF processing delays, receiving FFL issues, supply chain disruptions, natural disasters, acts of government, labor disputes, material shortages, carrier delays, or pandemic-related restrictions. Customer will be notified of any force majeure delays.
High-Value Order Verification Requirements
Orders Over $250: Orders totaling $250 or more require identity verification prior to processing. Merchant will initiate contact with customer within 5 business days of order placement using one or more of the following methods:

Required Verification Information: Customer must verify the following information to complete the verification process:

Additional Verification Methods: Merchant reserves the right to require one or more of the following verification methods for high-value or high-risk transactions:
- Address Verification Service (AVS): Automated comparison of billing address with bank records
- Card Verification Value (CVV/CVV2/CVC): Verification of 3-4 digit security code on card
- 3D Secure Authentication: Additional password/code entry (Verified by Visa, Mastercard SecureCode)
- Multi-Factor Authentication (MFA): SMS codes, app confirmations, or email verification
- One-Time Password (OTP): Unique single-use authentication codes
- Government-Issued Photo ID: Driver’s license, passport, or state ID verification
- IP Geolocation Analysis: Location verification matching billing/shipping addresses
- Device Fingerprinting: Analysis of device information and transaction history
- Bank Name Verification: Confirmation of issuing bank name on card
- Callback Verification: Independent phone verification using publicly listed numbers
- Billing Address Mail Confirmation: Written confirmation sent to billing address
- Signed Documentation: Requiring signature matching government-issued ID
- Video Verification: Live video call to confirm identity and card possession
Cardholder Authorization: If the customer completing the order is not the cardholder listed on the payment method, the actual cardholder must be present during verification or must contact merchant directly to authorize the transaction. Third-party purchases require explicit cardholder authorization.
Merchant may place an authorization hold on payment method for up to 30 business days during the verification process. This security measure is implemented to:
- Reduce fraudulent transactions
- Verify customer identity
- Confirm billing and shipping information accuracy
- Protect both merchant and customer from fraud
Failure to complete verification within 15 business days of initial contact attempt may result in order cancellation and refund.
Orders Over $1,000: Orders totaling $1,000 or more are subject to enhanced security protocols and extended processing timeframes of up to 45 business days from order date. These orders require:
- Successful completion of identity verification
- Enhanced fraud screening and review
- Verification of no prior fraudulent activity or payment disputes associated with customer
- Confirmation that no chargebacks or payment disputes have been initiated by customer
- Additional documentation may be required at merchant’s discretion
Customer acknowledges and agrees that high-value orders require additional security measures and extended processing times. These protocols protect against fraudulent transactions, identity theft, and payment fraud.
Refund Request Requirement: If an order has not shipped within the applicable timeframe (30 days standard, 45 days for orders over $1,000), customer must formally request a refund via email to curtis@arrowheadsurvival.com.. Refund requests must include order number and details.
FRAUDULENT CHARGEBACK WARNING: Under 18 U.S.C. § 1029, filing false credit card disputes or chargebacks with intent to defraud is a federal crime punishable by up to 15 years in federal prison and fines up to $250,000. Submitting a chargeback or payment dispute through a bank or credit card company after order has been verified and confirmed will be considered a fraudulent act and may result in:
- Criminal prosecution under federal and state fraud statutes
- Civil litigation for damages and legal fees
- Reporting to law enforcement agencies
- Permanent ban from purchasing
Customer acknowledges that filing false chargebacks constitutes fraud and agrees to use proper refund request procedures through merchant before initiating any payment disputes.
FIREARMS SHIPMENT & TRANSFER POLICY
Federal Firearms License (FFL) Requirement: All firearms must be shipped to a valid, current Federal Firearms License (FFL) holder. Customer is responsible for providing complete and accurate FFL information including:
- FFL holder’s business name
- Complete physical address (no P.O. boxes)
- FFL license number
- Contact phone number
- Copy of current FFL license
Purchaser Identity Requirements: The customer purchasing the firearm must be the same individual completing the ATF Form 4473 at the receiving FFL. Customer name on order, payment method, and government-issued ID must match the individual who will complete the 4473 transfer process.
Gift Purchases & Third-Party Transfers: If the firearm is purchased as a gift or being transferred to someone other than the purchaser, customer MUST notify merchant prior to shipment via:

Verification for Payment Authorization Only: This notification and enhanced verification process is required solely for payment authorization and fraud prevention purposes. The individual purchasing the firearm as a bona fide gift is the actual transferee/buyer under federal law and will complete ATF Form 4473 at the receiving FFL.
Customer must provide the following information:
- Purchaser’s full legal name and relationship to recipient
- Recipient’s full legal name
- Reason for third-party purchase (gift, transfer, etc.)
- Confirmation that recipient is legally eligible to possess firearms
- Receiving FFL information where recipient will complete Form 4473
Enhanced Verification for Third-Party Purchases: When the name on the order and payment method differs from the intended recipient, enhanced verification is required under federal law and merchant policy. This includes:
- Government-Issued Photo ID: Purchaser must provide clear photo showing themselves holding their U.S. government-issued photo ID (driver’s license, passport, or state ID) next to their face
- Written Authorization: Signed statement authorizing the gift/transfer
- Recipient Eligibility Verification: Confirmation recipient is not a prohibited person
- Additional documentation may be required at merchant’s discretion
Straw Purchase Warning: Under 18 U.S.C. § 922(a)(6) and § 932, it is a federal crime to purchase a firearm on behalf of someone who is prohibited from possessing firearms or to make false statements about being the actual buyer. Violations are punishable by up to 25 years in federal prison. Merchant will report suspected straw purchases to ATF and law enforcement.
Customer acknowledges understanding of federal firearms transfer laws and affirms they are the actual buyer or have disclosed the gift/third-party nature of the purchase.
ABANDONED PROPERTY POLICY – FFL TRANSFERS & SPECIAL ORDERS
FFL Transfer Abandonment: Any firearm shipped to an FFL dealer for customer pickup is subject to abandonment rules. Firearms left at the receiving FFL for more than 30 calendar days from the date of arrival notification will be considered contractually abandoned by customer. The receiving FFL will return the firearm to Arrowhead Survival at customer’s expense.
Special Order Abandonment: Special orders placed through Arrowhead Survival must be picked up within 30 calendar days of arrival notification at one of our locations. Failure to retrieve special orders within this timeframe will result in order being classified as contractually abandoned by customer.
Contractual Abandonment – Customer Forfeiture of Payment:
- Customer forfeits ALL payments made for abandoned items
- NO REFUND, NO EXCHANGE, NO STORE CREDIT will be provided for any reason
- Customer is responsible for all return shipping costs from receiving FFL to Arrowhead Survival
- Customer is responsible for any storage fees charged by receiving FFL
- Customer waives all contractual rights to refund of payments for abandoned orders
- This contractual abandonment does not alter legal title to firearms, which shall be handled in accordance with applicable law
Legal Disposition of Abandoned Firearms:
- Firearms returned to Arrowhead Survival will be processed according to Florida Statute § 790.08 and Florida Statute § 705 (Lost or Abandoned Property)
- Legal disposition may include resale, destruction, or surrender to law enforcement as required by federal and state firearms regulations
- Customer acknowledges separation between: (1) contractual forfeiture of payment (immediate upon 30-day period), and (2) legal disposition of firearm property (follows statutory procedures)
Customer Responsibility: It is customer’s sole responsibility to:
- Monitor their email and phone for arrival notifications from receiving FFL
- Arrange pickup within 30 calendar days of notification
- Complete all required paperwork including ATF Form 4473 at receiving FFL
- Ensure they can legally possess the firearm before ordering
No Exception Policy: The 30-day contractual abandonment period is strictly enforced with no exceptions. Extensions will not be granted for any reason including but not limited to: travel, illness, military deployment, background check delays, or FFL availability issues.
Customer acknowledges and agrees to this abandoned property policy by completing purchase.
BACKGROUND CHECK & FALSE STATEMENT POLICY
FAILED BACKGROUND CHECKS: If customer fails required federal background check for regulated items:
- Customer will IN NO WAY RECEIVE A REFUND FOR ANY REASON
- ABSOLUTELY NO REFUND will be provided under any circumstances
- NO EXCHANGE or store credit available
- Customer WAIVES ALL RIGHTS to legal action, claims, or lawsuits against merchant
- Customer acknowledges this waiver is knowing and voluntary
- This no-refund policy applies regardless of reason for background check failure
FALSE STATEMENT REPORTING: Under 18 U.S.C. § 922(a)(6), knowingly making false statements on ATF Form 4473 is a federal crime punishable by up to 10 years imprisonment and fines. IF CUSTOMER KNOWINGLY LIES OR PROVIDES FALSE INFORMATION on ATF Form 4473 or any required documentation, merchant will immediately file reports with appropriate federal agencies including but not limited to ATF, FBI, and other law enforcement agencies. Customer acknowledges and agrees that merchant has the right and obligation to report suspected violations of federal firearms laws.
Federal Law Notice: Per 18 U.S.C. § 922(g), § 922(n), and § 922(a)(6), it is a federal crime for prohibited persons to attempt to acquire firearms or to make false statements during firearm transactions, punishable by up to 10 years imprisonment and fines. Failed background checks indicate federal legal prohibition. Merchant has no legal obligation to complete sales to prohibited persons and bears no liability for customer’s inability to pass required screening.
ADDITIONAL FEES
- Returned Check Fee: $35
- Bad checks are a criminal offense under Florida law
- FFL Return Shipping: Customer responsible for all costs associated with returning abandoned firearms from receiving FFL
- FFL Storage Fees: Customer responsible for any storage fees charged by receiving FFL for abandoned firearms
LEGAL NOTICE
Florida Statute 501.142 – This policy is legally authorized. Any specific written agreement between parties takes precedence over this general policy.
Your Rights: This policy does not affect manufacturer warranties or Florida consumer protection laws for completed, legal sales.

In the event of any conflict between sections of these Terms of Service, the RETURNS & REFUNDS POLICY section takes precedence.

USED FIREARMS
Descriptions for used firearms are based on actual items and marked accordingly. Sales of used items are final. Photos are provided when available.
GENERAL FIREARM SALES
Firearms, magazines, and restricted items are sold according to federal, state, and local laws. Firearms are shipped only to licensed FFL dealers. Customers should check local laws before ordering. New firearms include manufacturer’s packaging, accessories, warranty, and are subject to manufacturer’s warranty policies.

Online inventory is subject to change. Errors in product descriptions or prices are not guaranteed. We reserve the right to refuse orders with errors and will not charge or will refund customers in such cases. Customers agree that we have the final say in online catalog discrepancies. Price error refunds constitute merchant error under our Limited Exceptions policy.
AMMUNITION PURCHASES
Ammunition buyers must be 18 (rifle/shotgun) or 21 (handgun). Ammunition is shipped with adult signature required and is non-returnable. All ammunition purchases are subject to local and federal laws depending on where the ammunition is shipped to. All ammunition sales are final with no refunds, returns, or exchanges.
